Who these Terms cover

These Terms & Conditions (“Terms”) govern your use of jessiecabello.com and the programs, courses, memberships, communities, bookings, and free resources offered by Jessie Cabello, operating under David Gendreau Estate, a sole proprietor based in Quebec, Canada (“I,” “me,” “my”). By accessing the site or purchasing or using any Service, you agree to these Terms; if you don’t agree, please don’t use the Services. You must be the age of majority where you live and able to enter a binding contract. If you use the Services for an organization, you confirm you’re authorized to bind it.

What I offer

I provide identity and business mentoring and related digital products — one-to-one mentorship, group programs, self-paced courses, memberships, community spaces, live calls, downloadable resources, and free tools like the Irreplaceable Genius Audit. What’s included, how long it runs, and the price are described at the point of sale and form part of these Terms.

Not professional advice

My Services are educational and developmental. I am not a licensed medical, mental-health, financial, or legal professional, and nothing I provide is medical, psychological, therapeutic, financial, or legal advice. Tools I reference — including Human Design and Gene Keys — are used for self-reflection and personal and professional development, not diagnosis or treatment. You are responsible for your own decisions and results, and I don’t guarantee any specific outcome, income, or result. For medical, mental-health, financial, or legal matters, always consult a qualified professional.

Prices, payment and bookings

Prices are shown at the point of sale and may be subject to tax. Payment is processed by my payment provider and/or course platform; you agree to provide accurate billing information and authorize the charge for the Service you select. Bookings made through my scheduling tool are subject to availability and any cancellation or rescheduling notice shown at booking.

Refunds and cancellations

All sales are final unless a refund policy is explicitly stated on the enrollment page at the time of purchase. Where a refund policy is offered, you must submit a written request to [email protected] within the stated refund period; requests received after that period won’t be honored, and you remain responsible for the full fee regardless of participation or completion. If no refund policy is stated, the purchase is non-refundable. Nothing here limits any non-waivable rights you have under applicable consumer-protection law, including in Quebec.

Memberships and subscriptions

Where a subscription renews automatically, you authorize recurring charges until you cancel using the stated process. You remain responsible for charges incurred before your cancellation takes effect.

Intellectual property

All content I provide — frameworks, course materials, videos, workbooks, text, and branding such as the Irreplaceable Genius name and logos — is owned by me or my licensors and protected by intellectual-property laws. I grant you a personal, non-transferable, non-exclusive licence to use purchased content for your own personal or internal business use. You may not copy, resell, share login access, publicly distribute, or create derivative works from it without my written permission.

Your content and testimonials

You keep ownership of content you submit (for example, messages, posts, or assessment responses). You grant me a licence to use it as needed to provide the Services. If you give a testimonial or review, you grant me permission to use it in marketing with the attribution you provide, unless you ask me in writing to stop.

Community guidelines

In any community space, engage respectfully, keep shared information confidential, and don’t post unlawful, harassing, or infringing content. I may remove content or suspend access that breaches these guidelines.

Third-party services

The Services rely on third-party platforms (such as Kajabi, Calendly, and payment processors) and may link to other sites. I am not responsible for third-party services or content, and your use of them is subject to their own terms.

Disclaimers and liability

The Services are provided “as is” and “as available,” without warranties of any kind to the fullest extent permitted by law; I don’t warrant that they’ll be uninterrupted, error-free, or complete. To the fullest extent permitted by law, I won’t be liable for indirect, incidental, special, or consequential damages, or loss of profits, data, or goodwill, and my total liability for any claim is limited to the amount you paid me for the Service giving rise to it. Nothing excludes liability that can’t be excluded under applicable law. You agree to indemnify and hold me harmless from claims, losses, and expenses arising from your breach of these Terms or misuse of the Services.

Termination

I may suspend or end your access if you breach these Terms. Provisions that by their nature should survive — including intellectual property, disclaimers, and limitation of liability — continue to apply.

Governing law

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada that apply there, without regard to conflict-of-laws rules. The courts of the judicial district of Sherbrooke, Quebec have jurisdiction, except where consumer-protection law lets you bring proceedings in your own jurisdiction.

Changes

I may update these Terms from time to time. The “Last updated” date shows the latest version, and continuing to use the Services after changes take effect means you accept them.
